GENERAL TERMS APPLICABLE TO ALL SERVICES
Force Majeure and Unforeseen Circumstances
Neither party shall be liable for any failure or delay in performance under this Agreement which is due to fire, flood, earthquake, elements of nature or acts of God, wars, riots, civil disorders, rebellions or revolutions, pandemics, government restrictions, or any other cause which is beyond the reasonable control of such party.
In the event that government health orders, venue restrictions, or health and safety concerns prevent in-person delivery of services, The Wellbeing Collective reserves the right to:
Convert services to online delivery format at no additional cost
Reschedule services to a mutually agreeable date
Provide alternative delivery methods that meet health and safety requirements
Clients will be notified as soon as reasonably possible of any necessary changes due to health restrictions.
Technology and Equipment Requirements
For online services, the Client is responsible for:
Providing stable internet connectivity for all participants
Ensuring access to required platforms (Zoom, Teams, etc.)
Technical support for participants during sessions
Testing technology in advance of scheduled sessions
Backup technology solutions in case of technical difficulties
The Wellbeing Collective is not responsible for service interruptions due to:
Client internet connectivity issues
Platform outages beyond our control
Participant technology difficulties
Venue technical problems
Recording and Confidentiality
Recording of live sessions (audio or video) requires express written consent from The Wellbeing Collective. Unauthorised recording is strictly prohibited and may result in immediate termination of services without refund.
All participants agree to maintain confidentiality regarding personal information shared by other participants during sessions. The Wellbeing Collective is not responsible for breaches of confidentiality between participants.
Participants may not reproduce, distribute, or commercially use any session content, materials, or methodologies without written permission from The Wellbeing Collective.
Participant Conduct and Safety
Participants are expected to:
Engage respectfully with facilitators and other participants
Arrive prepared and on time for sessions
Maintain professional behavior throughout all interactions
Respect diverse perspectives and experiences
The Wellbeing Collective reserves the right to remove participants who engage in:
Discriminatory, harassing, or abusive behavior
Disruptive conduct that interferes with learning
Sharing of inappropriate or harmful content
Violation of confidentiality agreements
While our services support wellbeing, they are not a substitute for professional mental health treatment. Participants experiencing mental health crises should seek appropriate professional help. The Wellbeing Collective may recommend external resources but cannot provide crisis intervention.
Intellectual Property and Content Ownership
All materials, including but not limited to content, slides, workbooks, exercises, assessment tools, and methodologies, remain the intellectual property of The Wellbeing Collective. Customization or adaptation of materials does not transfer ownership rights. Clients receive a license to use materials solely for the agreed purposes and may not reproduce, distribute, or modify the content without written permission.
Travel and Accommodation
For services requiring travel beyond 50km from Perth, additional charges apply:
Travel time at 50% of standard hourly rate
Accommodation costs for overnight stays
Meals and incidental expenses
Transportation costs (flights, car hire, fuel)
All travel expenses must be approved in writing before booking. If travel disruptions prevent service delivery, The Wellbeing Collective will work with clients to reschedule, provide alternative online delivery, or arrange local facilitator where possible.
Liability and Insurance
The Wellbeing Collective maintains professional indemnity insurance appropriate to the services provided. Our total liability for any claim shall not exceed the total amount paid by the client for the specific service giving rise to the claim.
Clients agree to indemnify The Wellbeing Collective against any claims arising from participant conduct, misuse of materials, breach of confidentiality by participants, or client's failure to meet technology or safety requirements.
Data Protection and Feedback Use
Personal information collected during services will be used solely for service delivery and improvement, stored securely, not shared with third parties without consent, and deleted upon request after service completion.
The Wellbeing Collective may use aggregated, anonymous feedback for service improvement, marketing materials, and research. Specific testimonials require written consent from participants.
Dispute Resolution
In the event of disputes, parties will first attempt direct negotiation, followed by mediation if necessary. Australian law governs all disputes, subject to Queensland court jurisdiction.
CORPORATE TRAINING AND CONSULTING SERVICES
Service Scope and Proposal Adherence
Services are specifically outlined in the agreed proposal, including content, duration, delivery format, and materials. All training content is proprietary intellectual property developed for the Client's requirements. Services not explicitly mentioned in the proposal are outside scope and may incur additional charges.
Minor Adaptations and Customization
Minor content adaptations of up to 5-10% of total program content are included within the agreed fee:
Minor terminology adjustments to align with company language
Small modifications to examples or case studies for industry relevance
Basic customization of company branding on materials
Adjustment of timing within sessions by up to 15 minutes
Minor reordering of existing content elements
Adaptations must be requested at least 5 business days prior to delivery and are subject to approval based on feasibility and learning objectives.
Additional Services and Scope Changes
Requests exceeding minor adaptations will be considered additional services and charged separately:
Restructuring of session content or flow beyond minor reordering
Development of new materials, exercises, or assessment tools
Significant changes to delivery format (in-person to online or vice versa)
Addition of extra sessions, modules, or extended duration
Major workbook redesigns or content reorganisation
Custom video production or multimedia development
Additional stakeholder meetings beyond those specified in proposal
Enhanced technology integration for virtual engagement tools
Change Request Process
All modification requests must be submitted in writing via email. The Wellbeing Collective will respond within 2 business days to confirm whether requests fall within included adaptations, provide quotes for additional services, and outline timeline implications.
No changes will be implemented until written approval and, where applicable, additional payment is received. Changes requested within 48 hours of delivery may incur rush charges of up to 25% of the additional service fee.
Payment Terms for Corporate Services
A non-refundable deposit of 50% of total delivery fee is required to secure booking. Remaining payment is due within 30 days of service completion.
Additional services must be approved in writing before commencement. Payment for additional services is required within 14 days of invoice. For significant additional work (exceeding $500), 50% deposit may be required before work commences.
Cancellation and Rescheduling
Corporate services may be cancelled no less than two weeks prior to scheduled delivery for full refund minus deposit. Cancellations less than two weeks before will forfeit deposit with remaining fees refunded. Cancellations less than 48 hours before delivery result in full fee liability.
Services may be rescheduled once without penalty if notification is provided at least one week prior, subject to availability.
Facilitator Substitution
In the event Annika Rose is unable to deliver services due to illness or emergency, The Wellbeing Collective may provide a qualified substitute facilitator, reschedule services, or offer alternative delivery arrangements. Clients will be notified as soon as possible of any substitutions.
PUBLIC WORKSHOP TERMS AND CONDITIONS
Subject to all terms and conditions, The Wellbeing Collective will allow attendance at workshops and provide resources to support learning and self-development as outlined on the website.
Substitution and Cancellation
If unable to attend, you may nominate another person provided The Wellbeing Collective is informed no less than 24 hours prior to the workshop date.
Tickets may be cancelled no less than one week prior to the workshop date for full refund 5 working days after workshop completion. Tickets cancelled less than one week before cannot be refunded. Once workshop begins, no refunds or credits will be given.
Workshop Delivery
The Wellbeing Collective cannot guarantee specific results from workshop attendance and has sole ownership of all content including copyright and intellectual property rights.
Fees are payable at point of purchase online. If full fee is not received prior to workshop commencement, access will be denied.
The Wellbeing Collective may cancel any workshop and terminate agreement by notice at any time.
Liability Disclaimer
Workshops are provided strictly "as is." All warranties are disclaimed to maximum extent permitted by law. The Wellbeing Collective shall not be liable for special, indirect, incidental or consequential damages arising from workshop cancellation, attendance, alterations, or delays.
Tickets shall not be reassigned without prior notification and approval.
SPEAKER BOOKING TERMS AND CONDITIONS
A non-refundable deposit of 50% of total delivery fee is required to secure booking. The date and service are not secured until deposit funds clear.
Payment of remaining amount will be made within 7 days of speaking event completion.
COACHING TERMS AND CONDITIONS
The Wellbeing Collective will provide coaching sessions and resources to support learning and self-development as outlined on the website.
Scheduling and Cancellation
If unable to attend a coaching session, notification no less than 24 hours prior is required to reschedule at no cost. Cancellation less than 24 hours before appointment requires full session cost payment.
Coaching Relationship
Coaching is not therapy or medical treatment. Clients experiencing mental health issues should seek appropriate professional help. The coach may recommend external resources but cannot provide crisis intervention or medical advice.
All coaching conversations are confidential, except where disclosure is required by law or where there is risk of harm to self or others.
DIGITAL PRODUCT AND E-COURSE TERMS AND CONDITIONS
Access and Usage
When engaging with digital products, customers must maintain reasonable measures to ensure only they have access to paid resources and e-course content. This includes protecting downloaded products, passwords, and access credentials. Sharing access with others is prohibited.
Upon payment, we grant a limited, revocable, non-exclusive, non-sublicensable and non-transferable licence to use the purchased product, personal to you and not shareable with others.
Restrictions
You shall not copy, modify, transmit, reproduce, download, distribute or exploit products or copyrighted materials except for personal, non-commercial use. We may suspend access immediately at our discretion or if you breach obligations under these terms.
You may not reproduce any work, communicate or share website content, including digital files, video or audio downloads, without permission. Contact hello@thewellbeingcollective.com to seek permission before re-using content.
Refunds
Refunds cannot be made for immediately downloadable digital items. Cancellation and refunds are available for e-course customers within 7 days of starting the course. For refund requests, contact hello@thewellbeingcollective.com.

Information Collection and Use
At The Wellbeing Collective, we respect and protect client privacy. This Privacy Policy explains how we collect and use information for services including wellbeing education, promotions, newsletters and offers. Using our services indicates agreement to information collection and use as outlined here.
We collect information to improve services, present relevant information, and measure success and performance. Analytics gives us visitor numbers and navigation patterns.
Personal Information
Unless you voluntarily provide personal information for specific purposes, we do not collect personal information. We never combine personal information with analytic information. When you provide personal information during registration or service use, we use it to provide requested products or services.

We will not sell, share, or rent information to others differently than disclosed here. However, we may transfer personal information in case of Wellbeing Collective sale or merger.

We may collect online identifiers with cookies, including IP address, browser type/version, and pages viewed. We track how you reach our site and links clicked to leave. Once you leave, we don't track you.

These Terms and Conditions may be updated periodically. Clients will be notified of material changes via email or website notice. Continued service use after updates constitutes acceptance of revised terms.
Existing contracts in progress at the time of updates will continue under original terms unless specifically renegotiated.
